Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Kood Khafeef For Information Technology Establishment ("CarRoots," "we," "us," or "our"), established in the Kingdom of Saudi Arabia. They govern your use of the CarRoots mobile application and related services (the "Platform") as a customer (a "User").

By creating an account or using the Platform, you accept these Terms. If you do not agree, do not use the Platform.

1. CarRoots Is a Marketplace — Not a Service Provider

1.1. CarRoots acts solely as an intermediary marketplace platform that connects Users seeking vehicle care services (such as mobile car wash and detailing) with independent automotive service providers ("Vendors") in supported cities in Saudi Arabia.

1.2. CarRoots does not itself provide, perform, supervise, or guarantee any vehicle care service. All services booked through the Platform are provided by Vendors, who are independent businesses and are not employees, agents, partners, or joint ventures of CarRoots.

1.3. The service contract for any booking is formed directly between you and the Vendor. CarRoots is not a party to that contract. CarRoots' role is limited to providing the technology that enables discovery, booking, scheduling, payment facilitation, and communication.

1.4. CarRoots does not warrant the quality, safety, legality, timeliness, or outcome of any Vendor's services, and does not endorse any Vendor. Ratings and reviews reflect the opinions of other Users, not of CarRoots.

2. Accounts and Eligibility

2.1. You must be at least 18 years old and capable of forming a binding contract.

2.2. You must register with accurate, complete, and current information, including a valid mobile phone number verified by a one-time code. You are responsible for all activity under your account and for keeping your credentials confidential.

2.3. We may suspend or terminate accounts that violate these Terms, applicable law, or the security of the Platform.

3. Bookings and Payments

3.1. Booking. You select a Vendor, service, optional add-ons, an available time slot, and a service location. A booking is confirmed only after payment is completed (or a valid package/subscription balance is redeemed) and verified by our systems.

3.2. Payments. Payments are made in Saudi Riyals (SAR) through our third-party payment gateway (currently Moyasar), by credit/debit card or Apple Pay. CarRoots facilitates payment collection on behalf of the Vendor; it does not store your full card details. Saved cards are stored as secure gateway tokens.

3.3. Packages and subscriptions. Vendors may offer multi-use packages or subscription-style offerings. Package balances are valid only with the issuing Vendor and are subject to the Vendor's stated conditions.

3.4. Pricing and invoicing. Prices are set by Vendors. Electronic invoices are issued in accordance with ZATCA (Zakat, Tax and Customs Authority) requirements.

4. Cancellations, Rescheduling, and Refunds

4.1. Bookings may be cancelled or rescheduled through the Platform subject to the applicable cancellation window and policy displayed in the app.

4.2. Vendors may request a reschedule (for example, due to weather or operational constraints); you will be notified and offered alternative slots.

4.3. Refunds are governed by our Refund Policy, available in the app, which forms part of these Terms. In general, refunds are not available for no-shows or cancellations outside the applicable cancellation window.

5. Your Responsibilities

You agree to:

  1. Provide accurate booking information, including correct vehicle details and service location;
  2. Ensure the vehicle is present and reasonably accessible at the booked location and time;
  3. Remove valuables and personal items from the vehicle before the service; Vendors and CarRoots are not responsible for items left in the vehicle except as required by law;
  4. Treat Vendor personnel respectfully and use the in-app chat only for lawful, service-related communication;
  5. Pay for booked services through the Platform and not circumvent the Platform to avoid fees;
  6. Submit only truthful ratings, reviews, and complaints;
  7. Comply with all applicable laws in connection with your use of the Platform.

6. Communications and Content

6.1. The in-app chat is provided per appointment to coordinate service delivery and may be unavailable outside the active life of an appointment.

6.2. You must not use the Platform to send unlawful, abusive, deceptive, or irrelevant content, or to solicit transactions outside the Platform.

6.3. By submitting content (reviews, photos, chat messages), you grant CarRoots a non-exclusive, royalty-free license to host, display, and process that content as needed to operate the Platform. We may remove content that violates these Terms.

6.4. You consent to receiving service-related notifications (push notifications, SMS/WhatsApp verification codes). You can disable push notifications in your device settings, but this may affect your ability to track bookings.

7. Disclaimers

7.1. The Platform is provided "as is" and "as available." To the maximum extent permitted by law, CarRoots disclaims all warranties, express or implied, regarding the Platform and regarding any services provided by Vendors.

7.2. We do not guarantee uninterrupted or error-free operation of the Platform, the availability of any Vendor or time slot, or the accuracy of Vendor listings.

8. Limitation of Liability

8.1. To the maximum extent permitted by the laws of Saudi Arabia, CarRoots' total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total amount you paid through the Platform for the booking giving rise to the claim.

8.2. CarRoots is not liable for indirect, incidental, special, or consequential damages, loss of profits, or loss of data.

8.3. CarRoots is not liable for the acts or omissions of Vendors, including service quality, delays, damage to your vehicle or property, or personal injury arising from a Vendor's performance. Such claims must be directed to the Vendor.

8.4. Nothing in these Terms excludes liability that cannot be excluded under the laws of Saudi Arabia, including mandatory consumer protections.

8.5. Disputes between Users and Vendors are primarily matters between those parties. CarRoots may, at its discretion, facilitate communication or review complaints submitted through the app, but is not obligated to resolve such disputes.

9. Indemnification

You agree to indemnify and hold harmless CarRoots, its owners, and its personnel from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.

10. Suspension and Termination

10.1. You may stop using the Platform and request account deletion at any time.

10.2. We may suspend or terminate your access immediately if you breach these Terms, abuse Vendors or other Users, engage in fraud or payment abuse, or where required by law. Outstanding bookings and payment obligations survive termination.

11. Intellectual Property

The Platform, including its software, design, logos, and content created by CarRoots, is owned by or licensed to Kood Khafeef For Information Technology Establishment. You receive only a limited, revocable, non-transferable license to use the app for its intended purpose.

12. Changes to These Terms

We may amend these Terms from time to time. Material changes will be notified through the Platform, and the "Last updated" date will be revised. Continued use of the Platform after changes take effect constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from these Terms or the Platform that cannot be resolved amicably shall be subject to the jurisdiction of the competent courts and committees of Saudi Arabia.
